Terms of Use

1. What is SellerTree?

SellerTree is a lightweight software tool that helps social sellers (for example, Instagram or WhatsApp sellers) create an online product catalog and generate structured WhatsApp orders. SellerTree does not operate as a marketplace, payment provider, bank, or logistics service. All commercial transactions — including pricing, payment, delivery, and customer service — take place directly between you and your customers.

2. Acceptance of these Terms

By accessing or using SellerTree (including creating a store, adding products, or sharing a SellerTree link), you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use SellerTree.

3. Your role as merchant

You are responsible for your business and your customers. Specifically, you agree that:

• You are the seller of record for all products and services that you list using SellerTree.
• You set and control your own prices, discounts, and stock availability.
• You are responsible for complying with all applicable laws and regulations, including any licensing, tax, consumer protection and e-commerce requirements in your jurisdiction.
• You are responsible for providing accurate product information, photos, and descriptions.
• You are responsible for handling all customer inquiries, complaints, refunds, and after-sales support.

4. No payment processing, no escrow

SellerTree does not process, receive, hold, or transfer any customer funds on your behalf. The platform only:

• Displays your product catalog in a simple storefront page; and
• Generates a pre-filled WhatsApp message that your customer can send to you to place an order.

You are solely responsible for arranging payment collection (for example, cash on delivery, bank transfer, or any third-party payment link you choose to use) and for complying with associated regulatory requirements.

5. Account and store usage

When you create and manage a SellerTree store, you agree to:

• Provide accurate and complete information about your email, store name, WhatsApp number, and any other requested details.
• Keep control of access to your email account which is used for login via magic link.
• Immediately notify us if you become aware of any unauthorised access or suspected security issue.
• Not share or resell access to your SellerTree account to any third party without our prior written consent.

6. Acceptable use

You agree not to use SellerTree for any illegal, harmful, or inappropriate purpose. This includes (without limitation):

• Selling products or services that are illegal, counterfeit, unsafe, or prohibited under applicable law.
• Sharing content that is hateful, abusive, defamatory, or misleading.
• Attempting to interfere with or compromise the security or performance of SellerTree or any related systems.
• Scraping, reverse-engineering, or attempting to circumvent technical protections.
• Using SellerTree to spam users or send unsolicited commercial communications in violation of applicable regulations.

7. Data and analytics

SellerTree logs certain data points to operate the service and provide you with basic analytics. This may include:

• Store configuration and product catalog data you input.
• Non-financial order metadata such as product ordered, variant, quantity, timestamp, and basic customer details typed into the form (e.g. name, area, notes).
• Technical information about device, browser, and usage patterns for security and performance.

SellerTree does not read or store the content of your WhatsApp conversations. Once the pre-filled order message is sent from the customer's device, it is handled by WhatsApp and your own device/accounts. For more details, please refer to our Privacy Policy.

8. Intellectual property

SellerTree retains all rights, title, and interest in and to the platform, including all software, design, logos, and other intellectual property, except for content that you provide (such as your product photos and descriptions).

You grant SellerTree a non-exclusive, worldwide, royalty-free license to use, display, and process the content you upload or configure solely for the purpose of providing and improving the service.

9. Disclaimers

SellerTree is provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

• We do not guarantee that the platform will be error-free, uninterrupted, or suitable for your specific business needs.
• We do not guarantee any increase in sales, customers, or profitability.
• We do not review or approve your products, business model, or compliance with local regulations.

10. Limitation of liability

To the maximum extent permitted by law, SellerTree and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or related to your use of the platform. Our total aggregate liability for any claim relating to the platform will be limited to the amount you have paid (if any) for access to SellerTree in the 3 months preceding the event giving rise to the claim.

11. Suspension and termination

We may suspend or terminate your access to SellerTree at any time if we reasonably believe that you have violated these Terms, used the platform in a way that creates risk for us or other users, or where we are required to do so by law or by a third-party provider (for example, hosting or infrastructure partners). You may stop using SellerTree at any time by no longer sharing your store link and deleting your data where possible.

12. Changes to these Terms

We may update these Terms from time to time to reflect changes in the platform, legal requirements, or business needs. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of SellerTree after any changes means you accept the updated Terms.
